Current service clarification · 3 October 2026: use the user guide for the current connector, account authorization and own-number setup. Calls require an explicit request and applicable permissions, are limited to 600 seconds connected time, and provide no audio-file recording. Connecting does not guarantee calling access. Any subscription provisions below apply only where a subscription is actually offered and accepted; this guide does not advertise paid plans.
These terms of service (“Terms”) are an agreement between you and OSCARFED PTE. LTD., 50 Tagore Lane, #03-01, Singapore 787494 (UEN 202209002E) (“Oscarfed”, “we”, “us”), which operates DialAgent. They apply to dialagent.com and the DialAgent connector, apps and API (the “Service”). By creating an account, connecting DialAgent to an AI assistant or otherwise using the Service, you accept these Terms. If you use the Service for an organisation, you confirm you may accept them on its behalf, and “you” includes that organisation.
1. The Service
DialAgent lets AI assistants you use, such as ChatGPT, Claude, OpenClaw or your own agent, place phone calls on your behalf and return the results. Calls are made by an AI voice that identifies itself as an AI. Audio-file recording is disabled. Available conversation text may be retained. The Service calls numbers in the United States, Canada and Europe, between 8 am and 9 pm in the local time of the person being called. Features, supported countries and limits are described on our website and may change.
DialAgent cannot call emergency services. In an emergency, call your local emergency number yourself, for example 911 or 112.
2. Your account and number
You must be at least 18 and able to enter into a binding contract. You verify a mobile number you own or are authorised to use; calls show that number as the caller ID. Keep your account, your connected assistants and your verification codes secure. You are responsible for all calls placed through your account and for keeping your details accurate.
3. Acceptable use
Use DialAgent only for calls the other person would reasonably expect from you or your business, such as bookings, service requests, enquiries, cancellations and messages. You must not use it for:
- telemarketing, cold outreach, sales campaigns, surveys, political or fundraising calls, or bulk dialling;
- debt collection;
- harassment, threats, pranks, or repeated calls to someone who has asked not to be called;
- fraud or scams, or pretending to be a human or a specific person;
- asking the other person for passwords, one-time codes, card numbers or similar secrets;
- calling emergency services, premium-rate numbers or numbers on our opt-out list;
- anything unlawful, including breaking telemarketing, consumer-protection, privacy or call-recording laws.
Our safety rules are part of these Terms. We screen call goals and may refuse or end a call, limit your use, or suspend or close your account if you break these rules, to protect the people you call or to comply with the law.
4. Calls made for you
You authorise DialAgent to speak for you within the instructions you give, including the information you allow it to share. Bookings, cancellations, requests and other commitments it confirms during a call are made in your name, and you are responsible for them, including any fees or cancellation charges the other party applies. If you choose to be asked first, your agent checks with you before it books something or agrees to pay; otherwise it follows the rules you set.
AI can misunderstand people or make mistakes. Check the summary and transcript before you rely on anything important. You must not instruct your agent to hide that it is an AI, and you are responsible for complying with the laws that apply to your calls.
5. Call data and consent
The AI assistant identifies itself as calling on your behalf. Audio-file recording is disabled. Available conversation text may be retained. If the other person objects, the agent ends the call. Where the law of the place where you or the other person are located requires more, such as explicit consent to recording, you are responsible for obtaining it or for not making the call.
6. Plans, payment and renewal
The free plan includes a set number of calls a month. Paid plans are billed in advance for each month, or each year if you choose yearly billing, and renew automatically at the then-current price until you cancel. You can cancel at any time in your account or by emailing us; cancellation takes effect at the end of the period you have paid for, and you keep access until then.
Prices are shown in US dollars. Taxes such as VAT or sales tax are added at checkout where required. Unused calls don’t roll over. A call is one conversation with one number, and a call-around counts each line. If a payment fails, we may pause paid features until it is resolved.
We may change prices or plan limits for future billing periods. We’ll tell you at least 30 days in advance, and you can cancel before the change applies.
7. Right of withdrawal and refunds
If you are a consumer in the EU, EEA or UK, you can withdraw from a paid subscription within 14 days of buying it, without giving a reason, by telling us at legal@dialagent.com, for example with the form below. If you asked us to start the Service during those 14 days, you pay only for the part of the Service provided until you withdraw, and we refund the rest within 14 days.
Apart from this and wherever else the law requires, payments are non-refundable and we don’t refund partial billing periods. A call that fails because of a fault on our side, never connects, or ends because the other side declines to speak with an AI doesn’t count toward your limit.
8. Demo calls
You may request a demo call only to a phone number you own or use. The current marketing website does not place demo calls. Any call through your connected assistant requires account and own-number setup, applicable permissions and an explicit request. Audio-file recording is disabled.
9. Third-party platforms
DialAgent works inside assistants and tools run by other companies. Their terms and privacy policies apply to your use of them, and we are not responsible for their availability, content or behaviour. ChatGPT, Claude and other product names are trademarks of their owners; DialAgent is not affiliated with or endorsed by them.
10. Your content
You keep ownership of your instructions, available transcripts and results (“your content”). You give us a worldwide, non-exclusive licence to host, process and transmit your content only as needed to run, secure and support the Service, as described in our privacy policy. You confirm you have the right to share the information you give your agent.
11. Our Service
We own the Service, the DialAgent name and logo, and the software. You may use them only as these Terms allow. You must not copy, resell or sublicense the Service without a written agreement with us, reverse engineer it except where the law allows, overload or disrupt it, or use it to build a competing service. Use of the API is subject to the limits in our documentation. If you send us feedback, we may use it freely.
12. Availability and changes
We work to keep DialAgent available, but we don’t promise uninterrupted service: maintenance, carrier outages and the third-party platforms it relies on can cause interruptions. We may change or discontinue features. If we remove a paid feature in a way that materially harms you, you can cancel and receive a pro-rata refund of prepaid fees for the rest of the billing period.
13. Disclaimers
To the extent the law allows, the Service is provided “as is” and “as available”. We don’t guarantee that a call will be answered, that the other party will agree to your request, or that results will be free of errors. The Service does not give medical, legal or financial advice.
14. Liability
We are liable without limitation for damage we cause intentionally or through gross negligence, for personal injury, and wherever the law does not allow liability to be limited. Otherwise, to the extent the law allows, we are not liable for indirect or consequential loss, lost profits or lost data, and our total liability for all claims relating to the Service is limited to the amount you paid us in the 12 months before the claim arose, or USD 100 if that is more. These limits don’t affect rights you have as a consumer that cannot be waived.
You will compensate us for third-party claims that result from calls you instruct in breach of these Terms or the law, to the extent the law allows.
15. Suspension and ending the agreement
You can stop using DialAgent and delete your account at any time. We may suspend or end your access if you break these Terms, if the law or a carrier requires it, or to protect the people you call, with notice where reasonable. Provisions that by their nature should continue, such as payment, liability and governing law, survive the end of the agreement.
16. Changes to these Terms
We may update these Terms. For material changes, we will tell you at least 30 days before they take effect. If you don’t agree, you can cancel before then; if you keep using the Service after the effective date, the updated Terms apply.
17. Governing law and disputes
These Terms are governed by the laws of Singapore, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The courts of Singapore have exclusive jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring proceedings in its courts. We’d rather solve problems directly first: write to legal@dialagent.com.
